    1. Subject to the terms and conditions set out below, the Seller agrees at all times to ensure that it does sell or attempt to sell any prohibited items via the Marketplace, which items shall include any product or service prohibited for sale via the Marketplace in terms of any Applicable Laws, as well as any product or service determined by Dooka, including, but not limited to, the following:

      ●      Alcohol beverages (including non-alcoholic beer) unless holding a valid liquor trading and distribution license

      ●      Drug and drug paraphernalia

      Examples include but are not limited to:

      ●      Tobacco and Nicotine Products

      ●      Marijuana and Cannabis Products

      ●      Cigars and Cigarettes

      ●      E-cigarettes, Hookah Pens, and Vape Pens

      ●      E-Juice, E-Liquid, Vape liquid, and other Variants

      ●      Tobacco, Marijuana, Cannabis, and Hemp Seeds

      ●      Poppers and Muscle Relaxants

      ●      Mod Boxes and Vape Kits

      ●      Recreational and/or Party Drugs

      ●      Pill Press Machines

      ●      Prescription Drugs

      ●      Medicine and Healthcare Policies

      ●      Gambling/ Slot machines

      ●      Plants and Seeds

      ●      Unlocking/ Hacking Software

      ●      Tobacco and Nicotine products

      ●      Virtual/ Digital Goods, intangible items or services

      Examples include but are not limited to:

      ●      Gift cards or access codes (unless otherwise approved by Dooka)

      ●      Subscriptions to channels, websites, or other memberships

      ●      Virtual money for online games

      ●      Purchased Social Media Followers

      ●      Cryptocurrency delivered in digital or physical form

      ●      Adult and Graphic Sexual Content

      ●      Unnecessary Demonstration of Intimate Products

      ●      Mounted Specimens

      ●      Taxidermy

      ●      Some animal products that are allowed but with restrictions include leather, Silk, Fish Oil, and Animal Traps.

      ●      Artifacts, Grave-related items

      ●      Charity And Fundraising

      ●      Clothing (Used)

      ●      Cosmetics (Used)

      ●      Counterfeit Items

      ●      Counterfeit Currency and Stamps

      ●      Credit Or Debit Cards unless services through registered financial institutions

      ●      Currency Selling in any format, physical or digital

      ●      Documents, Manuals, IDs, Licenses, Uniforms or other Materials manufactured or distributed by transportation industries or Government institutions

      ●      Unauthorized resale of Event tickets

      ●      Firearms and Weapons

      Examples include but are not limited to:

      ●      Switchblade Knives

      ●      Butterfly Knives

      ●      Guns

      ●      Gun Parts

      ●      Gun Kits

      ●      Ammunition

      ●      Mace

      ●      Pepper Spray

      ●      Black Powder

      ●      Stun Guns

      ●      Explosives

      ●      Firewood Or Lumber (Not Including Artificial Or Manufactured Fire logs)

      ●      Fireworks & Pyrotechnical Devices

      ●      Government Documents, IDs and Licenses, including those from transportation industries

      ●      Human Remains or Body Parts

      ●      Items encouraging Illegal activity – e.g. an E-book describing how to create an explosive device

      ●      Lock picking devices

      ●      Lottery tickets

      ●      Mailing lists and personal information

      ●      Military ordinance

      ●      Multi-level marketing, pyramid and matrix programs

      ●      Offensive material – Examples include ethnically or racially offensive material and memorabilia

      ●      Illegal Pesticides or without required resale/distribution license

      ●      Police-related items

      ●      Military related items

      ●      Political memorabilia (Reproduction)

      ●      Illegal or Unethical services

      ●      Escorts, Unregistered medical practices, unregistered financial services etc.

      ●      Recalled items including but not limited to; any previously faulty item, dangerous item or hazardous item.

    2. Subject to paragraph 3 below, Dooka reserves the right, in its sole discretion and on a case-by-case basis, to exempt, with or without conditions, an item from the Prohibited Items list set out above, where (a) the sale of the item is not prohibited by Applicable Law; and (b) Dooka deems the sale of such item to be fit for purpose for a particular Buyer.
    3. The following terms and conditions apply to any exemption sought from and/or granted by Dooka pursuant to paragraph 2 above:
      • Dooka may grant an exemption mentioned in paragraph 2 above out of its own volition or upon written application by a Buyer or Seller;
      • Where a Buyer or Seller wishes to apply for an exemption mentioned in paragraph 2 above, it shall submit to Dooka a written request for such exemption signed by authorised signatories of the Seller, which request must set out in detail: (i) the nature, scope and duration of the exemption being sought; (ii) whether and why the exemption being sought meets the criteria set out in paragraph 2 above; (iii) the reasons why the exemption is necessary and appropriate; (iv) all risks that may arise should such exemption be granted; and (v) all measures that may be undertaken to mitigate such risks.
      • Any exemption granted by Dooka pursuant to paragraph 2 above shall apply only in respect of the Seller(s), Buyer(s) and item(s), and only on the conditions, as specified by Dooka in writing to the Seller(s) and/or Buyer(s) concerned.
      • Any exemption granted by Dooka pursuant to paragraph 2 above may be withdrawn by Dooka at any time where Dooka, in its sole discretion, determines that the criteria set out in (a) and (b) of paragraph 2 above are no longer satisfied.

Duka Afrika Portal Ltd, a Private Company with registered offices at Unit 201 Level 1 Gate Avenue – South Zone, Dubai International Financial Centre (DIFC) and holding Commercial License number 5278, hereby gives notice that its DIFC Private Company shall be wound-up on or before 31st December 2023.

Any queries, claims or objections regarding the proposed winding up and closure of the Private Company are requested to be forwarded to Mr. Sam Oppenheimer, CEO in writing to sam.oppenheimer@dooka.com within Seven (7) days from the date of publication of this notice (5th December 2023).
